(Oral) The present petition is for issuance of writ in the nature of mandamus directing the respondent to extend the parole of the petitioner due to sudden medical emergency/injury to the petitioner in F.I.R No. 44 dated 21.02.2015 under Section 376-DE/323/506 IPC and Section 6 of POCSO Act, 2012, registered at P.S. Ladwa District, Kurukshetra.

This Court, vide order dated 09.02.2023 had issued notice to the State and extended the parole of the petitioner till today i.e 24.02.2023. Today, a report dated 23.02.2023 has been filed in the Court by Supdt District Prison, Karnal stating therein that the facts were got verified from SHO Naggal, District Ambala vide office letter dated 15.02.2023. A medical report dated 22.02.2023 of Dr. Gayatri Mor, IPD and TPA Manager, Adesh Medical College & Hospital Mohri has been received. It has been stated that the petitioner was suffering from # D8 D9 Vertebra body left transverse process of D5-D10 vertebra and 8th, 9th rib. HE was admitted in Adesh Medical College & Hospital Mohri and got treatment for the same. The medical certificate was issued on 06.02.2023 stating therein that petitioner was treated conservatively along with physiotherapy and other supportive and discharged in stable condition. CRWP-1267-2023 In view of the above report, the present petition is disposed of and the parole of the petitioner is extended till 03.03.2023. The petitioner is directed to surrender before the concerned authorities on 04.03.2023 at 10 o'clock at the concerned jail after the expiry of his parole period.
