***** KARAMJIT SINGH , J. (Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.254 dated 26.7.2021 registered under Section 398 IPC & Section 25 of Arms Act at Police Station Adampur, District Hisar.

The counsel for the petitioner contended that FIR in this case was registered against the unknown persons and that the petitioner in this case was later on arrested and is in custody for the last about 8 months. The counsel for the petitioner made prayer for grant of regular bail to the petitioner.

The present petition is opposed by the State counsel, who submitted that the petitioner is also facing two other criminal cases and he is in custody even in those two criminal cases.

( 2 ) CRM-M-7690-2022 I have considered the submissions made by counsel for the petitioner as well as by State counsel.

The present case is relating to attempt made by three unknown young boys to rob the ICICI bank on 26.7.2021. FIR was registered against three unknown persons. Petitioner was later on arrested in July, 2021. During investigation certain recoveries were effected. On completion of investigation challan has been presented in the Court concerned. It will take time for completion of trial, which is yet to commence. The pendency of two other criminal cases against the petitioner, is no ground to decline the present petition.

Keeping in view facts and circumstances mentioned above, no fruitful purpose is going to be served even if the petitioner is kept in judicial custody for indefinite period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the CJM/Duty Magistrate concerned.
