In the present petition, the challenge is to the impugned award dated 05.11.1999 (Annexure P14).

While issuing the notice of motion on 01.02.2000, the operation of the impugned order dated 05.11.1999 (Annexure P-14) was stayed by the then Division Bench of this Court, subject to provisions of Section 17-B of the Industrial Disputes Act, 1947.

Learned counsel appearing on behalf of respondent No. 2 submits that he had tried to contact respondent no. 2, but respondent No. 2 is not responding and even the letter was also sent to him but the same came back unserved, hence, he is not in contact with respondent No. 2. Upon this, learned Senior counsel for the petitioner submits that as the respondent no. 2 is not responding to defend the present petition, the present petition may kindly be disposed of having been not pressed any further with liberty to the petitioner to revive the same in case respondent No.2 takes any action to get the impugned order dated 05.11.1999 (Annexure P-14) executed.

Ordered accordingly.

It is further directed that without prior permission of this Court, the impugned award dated 05.11.1999 (Annexure P-14) will not be executed. 6.
Pending civil miscellaneous application, if any, stands disposed of.
