Anupinder Singh Grewal, J (Oral) The petitioner is seeking regular bail in FIR No.334 dated 17.12.2018 under Section 379 IPC, registered at Police Station, Civil Lines, Patiala.

Learned counsel for the petitioner contends that allegations in the FIR against the petitioner are that while he was pillion riding a scooty, he had snatched the purse of the complainant. He, however, contends the FIR is the outcome of a misunderstanding between the parties and the matter has now been compromised. CRM No.M-6472 of 2019 [2] copy of the affidavit of the complainant with regard to compromise. The petitioner is 27 years of age and is not involved in any other case. Learned counsel for the petitioner also contends that coaccused, namely, Navneetam Banger @ Nav who was driving the scooty has been granted the concession of regular bail by this Court vide order dated 2.4.2019 passed in Criminal Miscellaneous No.M-3189 of 2019. Learned State counsel, on instructions from ASI Bharat Bushan, is not in a position to dispute the factum of matter having been compromised.

In view of the submissions of learned counsel for the petitioner, especially that petitioner is 27 years of age; he is not involved in any other case; co-accused has been released on regular bail; and the matter has been compromised between the parties, the petitioner is entitled to the concession of regular bail.

Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner, namely, Rohit is ordered to be released on regular bail on is furnishing requisite bonds to the satisfaction of the trial Court/ Duty Magistrate.
