**** RAJ MOHAN SINGH, J.(Oral) Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C. in case bearing FIR No.171 dated 15.07.2020 registered under Section 420 IPC at Police Station Tanda, District Hoshiarpur, Punjab.
Notice of motion was issued on 23.02.2021 on the statement made by learned counsel for the petitioner that petitioner is ready to settle the issue by paying the requisite amount to the complainant and on the said statement, arrest of the petitioner was stayed. Thereafter the case was taken up on MOHMED ATIK 2021.10.07 18:03 I attest to the accuracy and integrity of this document
CRM-M-8370-2021 (O&M) 23.09.2021 and it was found that no such settlement has been arrived at so far.
An amount of Rs.2,33,000/- is still due to be paid to the complainant by the petitioner. The petitioner has cleverly availed the interim stay of arrest from 23.02.2021 till date without there being any real intention to honour the commitment. Today, learned counsel for the petitioner submits that the petitioner has made hectic efforts to settle the issue with the complainant, but in vain.
Last opportunity was granted to the petitioner on 23.09.2021 to abide by his statement and settle the dispute with the complainant. Petitioner has not brought any amount even today.
In view of aforesaid position, this Court has is left with no alternative except to dismiss the present petition. The same is dismissed accordingly.
