*** HARSH BUNGER, J. (Oral) This petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking a writ in the nature of Certiorari for setting aside the show cause notice dated 15.05.2023 (Annexure P-3) issued by the Regional Passport Office, Chandigarh.

Learned counsel appearing for the respondent(s)-Union of India informs the Court that the earlier application, submitted by the petitioner, seeking issuance of the passport stands closed vide letter dated 25.04.2024. A copy of the said letter dated 25.04.2024 has been handed over in Court today, which is taken on record, subject to all just exceptions and also a copy of the same has been supplied to learned counsel for the petitioner in Court today itself.

It is further submitted by learned counsel for the respondent(s)- Union of India that the petitioner has again applied for issuance of his HIMANI GUPTA 2025.02.10 16:55 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh
CWP-3021-2025 (O&M) -2passport vide his application dated 22.01.2025, and the said application is on hold as the petitioner has not clarified as regards the status of case F.I.R. No.204, dated 18.11.2022, under Sections 188 and 285 of the Indian Penal Code, under Section 67 of the Information Technology Act and under Section 27 of the Arms Act, registered against the petitioner, at Police Station Baragudah, District Sirsa.

At this stage, learned counsel for the petitioner fairly submits that in the said case F.I.R. No.204, dated 18.11.2022, charges have already been framed against the petitioner and in this view of the matter, learned counsel for the petitioner submits that he may be permitted to withdraw the instant writ petition at this stage with liberty to the petitioner to approach the concerned Court, where the trial in case F.I.R. No.204, dated 18.11.2022, under Sections 188 and 285 of the Indian Penal Code, under Section 67 of the Information Technology Act and under Section 27 of the Arms Act, registered at Police Station Baragudah, District Sirsa; is pending against the petitioner and to seek permission to depart from India in terms of the notification No.570(E), dated 25.08.1993, issued by the Ministry of External Affairs, Government of India.

In view of the above, the instant petition is dismissed as withdrawn at this stage with the liberty aforesaid. 6.
