The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to disburse incentive @ Rs. 15/- per quintal besides the normal milling charges. 2.

Mr. Robin Dutt, Advocate, submits that as per policy of the State Government, the petitioner was entitled to bonus @ Rs. 15/- per quintal in case of delivery of Rice on or before 31.03.2023. The petitioner was having CMR well before the date, however, it could not deliver fortified rice on account of non-supply of fortified rice kernels by a dealer authorised by the respondents. The delay occurred on account of lapse on the part of State agencies, thus, petitioner cannot be denied benefit of incentive. The petitioner has filed representation/legal notice dated 29.08.2023 (Annexure P-8) before the authorities.

Mr. Raman Sharma, Addl. A.G., Haryana, on the asking of Court, accepts notice on behalf of the respondents and waives service. He asserts that competent authority would look into grievance of the petitioner and pass an appropriate order.

Without adverting with merits of the case and in the wake of statement of State counsel, the petition stands disposed of. 6.

It is made clear that competent authority while adjudicating grievance of the petitioner would treat the present petition as representation of the petitioner.
