The present petition filed under Section 482 Cr.P.C., the petitioners/Jagrup Singh, Gurmit Singh and Lakhbir Kaur seek quashing of FIR No.85, dated 01.07.2020 registered under Sections 406, 498-A and 506 IPC at Police Station Rajasansi, Amritsar on the basis of compromise dated 08.02.2021 (Annexure P-2). The brief facts of the case are Kiranjit Kaur complainant filed a written complaint against Jagrup Singh and Others with the allegations that her marriage was performed with Jagrup Singh on 11.02.2018. Two days prior to her marriage, his cousin had expired, therefore, marriage was performed in a Gurdwara. Her father had already expired. The marriage was performed by her mother by giving customary gifts gold ornaments, cash amount to her husband and inlaws family. One motorcycle and gold ornaments were given to her father-in-law. Similarly other dowry articles including furniture,
-2fridge, washing machine etc. were handed over to her mother-in-law. Soon after marriage, the attitude of her in-laws family was strict towards her and they started mal-treating her. They were not happy with the dowry articles and the marriage performed by her mother. They started raising demand for Innova vehicle. She was ill-treated in the matrimonial home. She was abused. One lady Rajwant Kaur started visiting their house and she was told that in case their demand was not satisfied, they would perform marriage of her husband with Rajwant Kaur. She was even threatened to kill. Ultimately she was turned out the house in January, 2020. After enquiry, the present FIR was registered.
The petitioners have filed the present petition for quashing of FIR on the basis of compromise. The respondent No.2Kiranjit Kaur appeared through her counsel and confirmed the compromise. Both the parties were directed to appear before the Sub Divisional Magistrate, Ajnala for recording of their statements on the basis of compromise. The detailed report dated 12.09.2022 regarding compromise has been received. The statements of the parties were also recorded. Kiranjit Kaur-respondent No.2 confirmed the compromise with the petitioners and further stated that it has been effected voluntarily without coercion and undue influence. Similarly, all the petitioners also appeared before the Sub Divisional Magistrate, Ajnala and confirmed the compromise arrived at between the parties. ASI Gurbax Singh, Investigating Officer also stated that no accused
-3has been declared proclaimed offender nor any other criminal cases are pending against them.
I have considered the detailed report regarding compromise which clearly indicates that the parties have settled all their disputes with the intervention of their relatives. The compromise is effected with their free consent without any pressure. This compromise will bring peace and harmony in the society and they will be able to lead a normal life afresh.
Under these circumstances, no purpose would be served with the continuation of criminal proceedings in the aforesaid FIR. Therefore, the compromise arrived at between the parties is accepted and the FIR No.85, dated 01.07.2020 registered under Sections 406, 498-A and 506 IPC at Police Station Rajasansi, Amritsar along with consequent proceedings are quashed by accepting the present petition. The petition is accordingly disposed of.
