RAMENDRA JAIN, J. (ORAL) Custody certificate filed in Court today is taken on record. Through instant second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from 209 dated 15.08.2018 registered under Sections 15, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station City Kapurthala.

According to the prosecution, on the basis of secret information that petitioner was indulging in illicit trade of narcotics in his vehicle make Brezza bearing registration No.PB-09-AG-7655, police laid barrier and apprehended truck bearing registration No.PB-02-CR-7655 being driven by Jaswant Singh with 56 kgs of poppy husk.

Learned counsel for the petitioner inter alia contends that petitioner has falsely been implicated in the aforesaid FIR. He was not apprehended on the spot. Conclusion of trial may take a sufficient long RAVINDER SINGH 2019.02.20 14:08 I attest to the accuracy and authenticity of this document

On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail during pendency of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
