*** Ritu Bahri, J. (Oral) By way of filing present writ petition, petitioner is seeking issuance of writ in the nature of mandamus directing the respondents to demarcate his land bearing Khasra No. 5848 min in view of application dated 08.01.2021 (P-6).

Learned counsel for the petitioner submits that the petitioner is in continuous possession of the disputed land and now the respondents are bent upon to demolish the construction of the petitioner. The petitioner has placed on record the revenue record (P-1 to P-6) to prove that he is owner of the land in dispute, as per his share of his predecessor namely Sadhu. The application of the petitioner has to be decided under Section 18 of HUDA Act.

Without expressing any opinion on the merits of the case, the present petition stands disposed of by giving a direction to respondent No. 2 to decide the application dated 08.01.2021 (P-6), in accordance with law, within a period of two months from the date of receipt of certified copy of this order. However, the demarcation shall be carried out in the presence of the parties after giving them due notice.
