**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 391 dated 2.10.2019 under Sections 148, 149, 307, 323, 324, 326, 427 and 506 IPC registered at Police Station Ladwa, District Kurukshetra. Learned counsel for the petitioner submits that the petitioner has not been named in the FIR and it was only on the disclosure statement of co-accused Ajay Kumar, the name of the petitioner emerged and coaccused Ajay Kumar has been granted bail by the trial Court. He further submits that no injury has been attributed to the petitioner and he has been in custody since 03.10.2019 Learned State counsel, who is assisted by learned counsel for the complainant submits that though injured Bal Kishan has been examined GURPREET SINGH 2020.02.28 17:42 I attest to the accuracy and integrity of this document Chadigarh
CRM-M No. 6676 of 2020 -2but the complainant is yet to be examined. He further submits that out of 23 prosecution witnesses, 04 witnesses have been examined. The petitioner has been in custody since 03.10.2019. Out of 23 prosecution witnesses, only 04 witnesses have been examined. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.
Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
