The present petition has been filed under Article 226 of the Constitution of India for issuance of direction to the official respondent No.2 to decide the representation of the petitioner (Annexure P-6) and further direct respondents Nos.3 and 4 to not to harass the petitioner at the instance of private respondents No.5 to 7.

Learned counsel for the petitioner inter alia contends that the petitioner is an Accountant by profession and after the death of his father in 2021, he started maintaining the accounts of respondent No.5. After few days, on account of long association between the petitioner and respondent No.5, petitioner recommended one Ravi Verma for employment to respondent No.5. In the month of July and August, 2023, respondent No.5 withdrew huge amounts of money by way of cheques through his Peon and Driver from his saving account. When the petitioner enquired about the withdrawal of said amounts for the purpose of entry in the account books, respondent No.5 instead of giving satisfactory reply, lodged a complaint dated 10.10.2023 to the Director Bureau of Investigation Punjab, Chandigarh alleging a fraud committed upon him. The said complaint was marked to respondent No.3. Thereafter, respondent No.4 summoned the petitioner vide summoning order dated 26.10.2023 to appear in his office on 27.10.2023. CRM-M No.8405 of 2024      petitioner appeared on the said date in the office of respondent No.4 where private respondents No.6 and 7 were also present. The petitioner was physically assaulted in the office of respondent No.4 and was asked to make payment of Rs.7 lakhs to private respondents otherwise he would be implicated in a false case. It is further contended that the petitioner is continuously being harassed by respondents No.3 & 4 at the instance of private respondents No.5 to 7 by summoning him in the office of respondents No.3 and 4. In this regard, he has given a representation dated 28.01.2024 (Annexure P-6) to respondent No.2 but no action has been taken thereon so far.

It is further submitted that the petitioner will be satisfied in case the representation given by him is considered in a time bound manner and an appropriate order is passed thereon, in accordance with law. 4.

Notice of motion to the official respondents only. 5.

Mr. Subhash Godara, Addl. A.G., Punjab, who is present in Court, accepts notice for the official respondents and submits that the representation of the petitioner will be considered by the official respondents as expeditiously as possible, in accordance with law.

Without commenting on merits of the case, I dispose of this petition with direction to respondent No.2 to decide the representation of the petitioner (Annexure P-6) within a period of four weeks from the date of receipt of certified copy of this order. It is made clear that this order shall not be taken to protect the petitioner from legal action for violation of law, if any committed by him.
