On last of hearing i.e. 16.07.2024, the following order was passed which reads as under:

"Called again.

On the last date of hearing, this Court had passed the following order:- "Vide order dated 23.03.2023, notice had been issued to the applicant and as per the office report the same has been duly served. The order sheets of the present appeal demonstrate that the present appeal was filed in the year 2013 with an application for condonation of delay, in which notice had been issued but the same was dismissed in default on 23.02.2016 due to repeated nonappearance of the counsel for the appellant. However, on an application filed, the case was restored to its original number vide order dated 16.08.2017, however subsequent thereto, there has been no representation continuously on behalf of the appellant.

The notice issued vide order dated 23.03.2023 has been duly served for 08.08.2023 but even then there is no representation on behalf of the appellant.

In the light of the above, one last opportunity is granted to the counsel for the appellant to come present in the Court and address arguments.

Copy of this order be sent to the learned counsel for the appellant through registered e-mail id and in case, the matter is not argued on the next date of hearing, the same shall be proceeded in accordance with law.

Adjourned to 08.12.2023.
