The present petition has been filed by the petitioner seeking quashing of order dated 09.12.2024 (Annexure P-3) passed by the Court of learned Sessions Judge, Sirsa vide which his bail order was cancelled and he was directed to be summoned through non-bailable warrants of arrest in a criminal case having FIR No.113 dated 08.08.2018 under Section 365 of IPC and Section 25 of Arms Act (Sections 180, 379-A, 384, 385, 388, 389, 420, 467, 468, 471 and 506 of IPC added later on) registered at Police Station Ding, District Sirsa.

Counsel appearing on behalf of the petitioner inter alia submits that the petitioner was granted regular bail by this Court vide order dated 26.10.2021 (Annexure P-2) and thereafter the petitioner was regularly appearing before the trial Court. However, the petitioner failed to appear before the trial Court on 09.12.2024 on account of noting down of wrong date of hearing. CRM-M-6675-2025 2 not intentional. It is further submitted that it was single default on the part of the petitioner and that even now he is ready and willing to join the proceedings. Notice of motion.

Mr. Arjun Lakhanpal, Addl.A.G., Haryana accepts notice on behalf of the State and submits that the petitioner got absented on 09.12.2024 without any intimation to the Court concerned which resulted into passing of order Annexure P-3. There is no illegality or perversity in the said order. The petitioner himself has approached this Court seeking permission to join the proceedings before the trial Court and further there was single default on the part of petitioner which resulted into passing of order Annexure P-3.

In the light of the above, without expressing any opinion on the merits of the case, the present petition is hereby disposed of with a direction to the petitioner to appear before the trial Court concerned and on his doing so, within next 15 days, the petitioner is to be released on regular bail by the said Court to its own satisfaction subject to costs of Rs.7,000/- to be deposited by the petitioner with the District Legal Services Authority, Sirsa. Needless to say that the petitioner is to remain careful in future and to appear before the trial Court on each and every date fixed in trial.
