*** MANOJ BAJAJ, J.(ORAL) By filing the present petition under Section 438 of the Code of Criminal Procedure, the petitioner has sought anticipatory bail in FIR No.53 dated 24.06.2018, under Sections 336, 341, 506, 148 and 149 of the Indian Penal Code ('IPC' - for short), and Sections 25 and 27 of the Arms Act registered at Police Station Gharinda, District Amritsar Rural. On 13.02.2019, this Court had passed the following order:- "Learned counsel for the petitioner contends that interim concession of pre-arrest bail was extended by the Sessions Court vide order dated 03.07.2018 in case FIR No.53 dated 24.06.2018, however, after few days another FIR No.61 dated 08.07.2018 was recorded against the petitioner, wherein the concession of anticipatory bail was declined and thereafter, the petitioner surrendered before the Police.

It is contended that both the cases pertain to the same Police Station, however, the petitioner was not allowed to join in case FIR No.53 dated 24.06.2018. After release of the Sheetal Gawri 2019.04.06 11:34 I attest to the accuracy and integrity of this document Chandigarh petitioner in FIR No.

CRM-M-6378-2019 (O & M) -2to arrest the petition in this case.

Notice of motion for 03.04.2019.

Meanwhile, the petitioner shall join the investigation and would come present as and when called for and in the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 438(2) Cr.P.C. "

Learned State counsel, on instructions from ASI Raspal submits that the petitioner has joined the investigation and he is not required for custodial interrogation.

In view of the above, without expressing any opinion on the merits of the case, the interim bail granted by this Court vide order dated 13.02.2019, is made absolute.

The petition stands allowed.
