(ORAL) At this stage, the counsel appearing on behalf of the respondent submits that the respondent intends to withdraw the petition under Section 9 of the Hindu Marriage Act, which is sought to be transferred, but however, he was not able to do so, in view of the interim stay granted by this Court, in the present application.

The counsel for the respondent gives an undertaking that the respondent shall withdraw the petition under Section 9 of the Hindu Marriage Act, if so allowed by this Court, within a period of one week from today onwards, by way of filing an application before the Family Court.
