**** SANJAY VASHISTH , J. (Oral) Order dated 10.02.2023, says as under:- "Prayer in this petition, filed under Article 226 of the Constitution of India, is for issuance of a writ in the nature of habeas corpus.

Learned counsel for the petitioner submits that marriage of petitioner and Chahat Kaushal, aged about 23 years ( detenue ) was performed on 19.01.2023 and marriage certificate was also issued in that regard by Pracheen Guga Maari Ramakrishna Mandir, Sector 19-D, Chandigarh. Parents of the dentenue were present at the time of marriage and had affixed their signatures on the marriage certificate as witnesses. Counsel also refers to the photographs, where parents of the detenue and other family members are also present at the time of marriage and after marriage.

Counsel also submits that on 31.01.2023 there was a marriage of some relative of the detenue and on that pretext, Petitioner and detenue both had attended the marriage on 31.01.2023, but when both of them had to return on 01.02.2023, respondents No. 4 and 5 illegally detained the detenue and did not allow her to join the company of the petitioner in her matrimonial JAWALA RAM 2023.03.16 17:32 I attest to the accuracy and authenticity of this order/judgement.

CRWP-1313-2023 - 2 - house. Counsel also submits that now, Chahat Kaushal (detenue) who is legally wedded wife of the petitioner has been illegally detained by the parents of the detenue. Thus, he prays for appointment of Warrant Officer.

Notice of motion, for 16.03.2023.

In the meantime, Registry is directed to appoint a Warrant Officer, on payment of usual charges, who will visit the place(s) of alleged detention of detenue and if found in illegal detention, she be got released immediately, after recording her statement. Warrant Officer shall submit his detailed report in that regard on or before the date fixed by this Court." Today, on the very outset, learned counsel for the petitioner seeks withdrawal of present petition.

Dismissed as withdrawn.
