By way of instant writ petition filed under Article 226 of the Constitution of India, petitioner has approached this Court for issuance of a writ in the nature of mandamus declaring the action of the respondents in retaining the excess stamp duty paid by the petitioner in respect of Sale Deed dated 27.03.2023, Annexure P-6, and for directing the respondents to refund the excess amount.

Counsel submits that petitioner has submitted a representation dated 18.12.2023, Annexure P-2, to the competent authority for refund of the excess stamp duty, which has been deposited. Counsel submits that representation can be treated as an application under Section 52 of the Indian Stamp Act, 1899. 3.

State counsel has specific instructions from Sub Registrar, Bawal, to state that the representation, Annexure P-2, will be decided within a period of 3 months from today.

In view of above, writ petition is disposed of with a direction to the competent authority to take a final decision on the representation, Annexure P2, in accordance with law, within a period of 3 months from the date of communication of the copy of this order.
