(Oral) The instant petition has been filed by the victim seeking transfer of investigation pertaining to FIR No. 636, dated 28.10.2019, Police Station City, Jind, under Section 8 of the Prevention of Corruption Act, 1988 and Sections 120-B, 506 IPC, to any Police Station outside District Jind, under the supervision of an IPS Officer.

Notice of motion.

At this stage, Mr. Gurmeet Singh, AAG, Haryana, accepts notice on behalf of respondent-State.

It has been informed by learned State counsel that pursuant to order dated 25.3.2022, passed by learned Additional Sessions Judge, Jind, the matter has been investigated again by Assistant Superintendent of Police, PANKAJ KAKKAR 2023.02.22 16:43 I attest to the accuracy and authenticity of this document

CRM-M-7814-2023 (O&M) - 2 - and a cancellation report has been prepared on 14.01.2023, but the same is yet to be presented, as necessary approval from the higher authorities is yet to be accorded.

Having heard the learned counsel for the petitioner and also the State counsel, the instant petition is disposed off with a direction to respondent No.3-Superintendent of Police, Jind, District Jind, to examine the entire case before fresh final report under Section 173 Cr.P.C. is presented again to the Court concerned. It be also ensured that statement of the petitioner is also recorded, if the Assistant Superintendent of Police, concerned, has not recorded the same.
