Learned counsel submits that the petitioner has already been paid compounding fee/penalty, thus, prays for withdrawal of the present petition with liberty to take this plea before the Court concerned along with the other being available, in accordance with law, at the appropriate stage, however, prays for exemption from personal appearance of petitioner with any conditions.

Petitioner is granted exemption from his personal appearance before the trial Court during pendency of the case, subject to his filing an affidavit before the Court concerned that he has no objection in case, the proceedings before it are held in his absence; in the presence of his counsel and shall appear before the said Court as and when his presence would be absolutely necessary.
