Mr. Neeraj Poswal, AAG, Haryana *** Amol Rattan Singh, J. (Oral) CRM no.29684 of 2021 in CRM-M-6066 of 2020 CRM no.30178 of 2021 in CRM-M-6075 of 2020 Vide these two applications, the applicant-petitioner seeks to place on record a prescription slip dated 10.12.2019 as Annexure P-3 in each of the petitions. He also seeks to place on record the orders passed by the learned trial court dated 17.02.2020, to the effect that the petitioner had surrendered before that court on that date itself pursuant to the interim order passed by this court on 10.02.2020, and had been admitted to bail upon him furnishing a bail bond in the sum of Rs.50,000/- with one surety in the like amount in each complaint, with learned counsel submitting that two applications have been necessitated as the petitioner was admitted to bail by the trial court, upon surrendering, in the context of two criminal complaints
-2instituted in that court, both the under the provisions of Section 138 of the Negotiable Instruments Act, 1881 (thereby necessitating two such orders to be passed by that court).
Notice in both the applications, with Mr. Neeraj Poswal, learned AAG, Haryana, accepting notice on behalf of the respondent State, on the asking of the court in each petiton.
It is to be noticed here that after notice of motion was issued pursuant to the order dated 10.02.2020 passed by this court (coordinate Bench), the report of the Registry on the next date of hearing was that respondent no.2, i.e. the complainant in the complaints instituted before the trial court, stood served through his father. However, thereafter none has put in appearance on his behalf.
Consequently, without making any comment on the actual merits thereof, these applications are allowed subject to all just exceptions, with the aforesaid documents ordered to be taken on record as Annexures P3 and P-4 respectively with each petition. CRM-M-6066 of 2020 CRM-M-6075 of 2020 Though in the medical prescription dated 10.12.2019 it is shown that the petitioner was suffering from high blood pressure of 150/90 mm hg, for which he has been prescribed certain medicines, however, without going into the authenticity of the aforesaid medical prescriptions, in view of the fact that even the complainant has not put in an appearance during all this period, possibly because he too would be wanting proceedings before the trial court to continue, these petitions are allowed,
-3with the order dated February 10, 2020 passed in each case made absolute, with the petitioner to continue to remain on bail on the same bail and surety bonds already furnished, subject to his continuing to appear in both the complaints as and when summoned by the trial court. A copy of this order be placed on the file of the other connected matters too.
