On 4.2.2026, the following order was passed:

'Petitioner, an accused in case FIR No.74 dated 27.05.2025 registered against him, for commission of offences punishable u/s 21-B and 27-A of NDPS Act (Section 29, 61, 85 of NDPS Act added later on) at P.S. Sultanwind, District Police Commissionerate Amritsar, has prayed for grant of pre-arrest bail.

Learned counsel submits that the petitioner has been falsely implicated in the present case on the basis of disclosure statement suffered by coaccused Prince Singh, who was allegedly caught red handed at the site keeping in his illegal possession 29 grams of Heroin ('Intermediate Quantity') and Rs.1100/- as drug money. Learned counsel further submits that said disclosure statement, in the absence of recovery of any other incriminating material, is not admissible in evidence. Learned counsel further submits that petitioner, who is a person of clean antecedents, is nonetheless willing to join the investigation as and when called for by the IO.

Notice of motion.

CRM-M No.6151 of 2026 -2Mr. Kamalpreet Bawa, DAG, Punjab, accepts notice on behalf of respondent-State and seeks time to file detailed status report. Adjourned to 20.04.2026.

In the meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).' 2.

Learned State counsel has filed status report by way of affidavit of Parvesh Chopra, PPS Assistant Commissioner of Police (South), Amritsar City, in Court today. The same be kept on record. Raising submissions in tandem with the said status report, learned State counsel submits that pursuant to the order dated 4.2.2026, the petitioner has joined investigation and is no longer required for custodial interrogation. 3.

In view of the stance of the State, especially the factum of the petitioner having joined investigation and he being arrayed as an accused on the basis of disclosure statement, this Court is inclined to confirm the order dated 4.2.2026, in light of the dicta of the judgment passed by this Court in CRM-M-54032-2024 'Ashu Vs. State of Punjab' and recent judgment of the Hon'ble Supreme Court passed in 'Jugraj Singh Vs. State of Punjab' bearing Special Leave to Appeal (Crl.) No.9190/2025. 4.

In view of the above, the instant petition is allowed. The interim order dated 4.2.2026, passed by this Court is made absolute, subject to the conditions as enumerated under Section 482(2) of BNSS. 5.

This order should not be treated as "blanket" order. It will not be read granting petitioner indefinite protection from arrest. It shall be

CRM-M No.6151 of 2026 -3confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 6.

Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS or upon showing any other sufficient cause.
