(ORAL) Counsel for the petitioner states that the petitioner was dismissed from service, vide order dated 27.11.2014, on the ground that he was convicted in FIR No.132 dated 16.05.2013 and was sentenced for one year rigorous imprisonment with `10,000/- as fine. Counsel for the petitioner further states that the conviction has been set aside by this Court in CRA-3033-SB-2014, vide order dated 13.09.2018 (Annexure P-2). He further states that in view of the said fact, the petitioner is entitled to be reinstated in service as the ground of his termination is no longer available.

Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has submitted the representation dated 29.10.2018 (Annexure P-3), which NARESH KUMAR 2019.02.12 11:22 I attest to the accuracy and integrity of this document Chandigarh

CWP-3539-2019 -2is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representation. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the representation dated 29.10.2018 (Annexure P-3) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
