  1. Through this third petition, as instituted under Section 482 of the B.N.S.S., 2023, the petitioner seeks the concession of anticipatory bail, in FIR No.92 dated 23.09.2024, under Sections 109, 191(3), 190, 115(2), 118(1), 61(2) of the B.N.S., 2023, registered at P.S. Sadar Phagwara, District Kapurthala.

2. Petitioner's earlier two petitions bearing No. CRM-M55083-2024 and CRM-M-4817-2025 were dismissed as withdrawn by this Court, vide the respective orders dated 07.11.2024 and 28.01.2025, however, in the latter order, liberty was granted to the petitioner to reaccess this Court on the same cause of action but with better particulars.

3. Now, this third petition has been filed for grant of anticipatory bail, primarily on the ground that, the matter has been compromised between the complainant, injured and the petitioner. To substantiate this claim, the learned counsel for the petitioner makes dependence upon the compromise dated 07.01.2025 (Annexure P-3). The learned counsel for the petitioner submits that when the complainant/injured is not ready to support the case of prosecution, Neha 2025.03.12 14:47 I attest to the accuracy and integrity of this document

$$%&'%$& $$ therefore, putting the petitioner behind the bars, for commission of the alleged offence(s), would tantamount to sheer abuse of process of law.

4. Taking into account the supervening events (supra), this Court deems it appropriate to entertain this third petition for grant of anticipatory bail.

5. Notice of motion for 12.03.2025.

6. Mr. Pardeep Bajaj, D.A.G., Punjab, accepts notice on behalf of respondent-State of Punjab.

7. In the meantime, the petitioner is directed to join the investigation and to appear before the investigating agency, as and when called upon to do so. In the event of his arrest, he shall be admitted to interim bail on his furnishing bail bonds to the satisfaction of the Arresting/Investigating Officer. The petitioner shall abide by the terms and conditions as envisaged under Section 482(2) of the B.N.S.S., 2023. =
