(Oral) The petitioner has approached this Court under Articles 226/227 of the Constitution of India, seeking a writ of Certiorari, for setting aside the notice dated 02.02.2019 (Annexure P-3). A further prayer for issuing direction to the respondent-Bank to grant 3 months more time for depositing the entire amount/complying with the settlement dated 20.12.2018 (Annexure P-1), has also been made.

Learned counsel for the petitioner states that inadvertently certain essential facts could not be incorporated in the present writ petition. Accordingly, a request was made by learned counsel for the petitioner that he may be allowed to withdraw the present writ petition with liberty to file fresh one on the same cause of action with better particulars.
