******* SURINDER GUPTA, J.(Oral) This is second petition filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No. 218 dated 01.11.2017 registered for the offences punishable under Sections 302, 201 and 120-B of Indian Penal Code, at Police Station Babain, District Kurukshetra.
Main witness Gaurav Kumar is stated to have been examined. Learned State counsel submits that the witnesses have fully supported the case of prosecution. Now, the application has been moved under Section 311 Cr.P.C. to summon formal witnesses i.e. one draftsman and Head Constable Dharminder Singh, who had prepared the videography of WhatsApp Chat. Prosecution will conclude the evidence in case the application is allowed by taking short dates. CRM-M-6133-2019 -2Keeping in view the fact that material witnesses have been examined and the case is at advance stage, I find no reason to allow this bail application. The same is dismissed.
However, learned trial Court is directed to expedite the disposal of the trial and conclude the same within two months after the conclusion of evidence by prosecution. The above direction has been given as per request made by learned counsel for the petitioner.
