This petition has been filed under Section 528 BNSS for issuing direction to respondent Nos. 1 to 2 to arrest the respondent No.4 in criminal complaint No. 6201/2004 (P-1) under Sections 138 and 142 of N.I.Act titled as M/s. UDS Offset Pvt. Ltd. Vs. M/s. Shah Times and another in which the respondent Nos. 3 and 4 were declared proclaimed person vide order dated 03.04.2012 (P-2) passed by learned JMIC, Faridabad and FIR No. 0182 dated 26.02.2018 under Section 174-A IPC(P-3) was registered against respondent No.4 at Police Station Sector-7, Faridabad.

Learned counsel for the petitioner submits that directions may be issued against private respondents No. 3 and 4 since they have not been arrested.

In view of the statement made by the learned State counsel, the present petition stands disposed of with a direction to the State counsel to file the untraceable report before the trial Court and thereafter, the counsel for the petitioner is at liberty to file the protest petition to the said untraceable report.
