(ORAL) In the present writ petition, the petitioner is challenging the order dated 16.01.2019 (Annexure P-9) by which claim of the petitioner for the grant of promotional increment on completion of 23 years' service has been rejected.

Learned counsel for the petitioner states that the claim of the petitioner has been rejected in January, 2019, even though the respondents have issued a Clarification in respect of the grant of the said benefit on 21.08.2018. In view of the Clarification, the case of the petitioner is now squarely covered in his favour for the grant of the said benefit. Learned counsel further states that a bunch of writ petitions, wherein also the same prayer was made i.e. for the grant of promotional increment after completing 23 years of service, came for consideration before the Co-ordinate Bench and the said bunch of writ petitions was decided on 29.11.2018. Learned counsel for the petitioner prays that ignoring the rejection of the case of the petitioner on 16.01.2019 (Annexure P- 9) and in view of the Resolution passed by the respondent/corporation as well as the order passed by a Co-ordinate Bench of this Court in Balvir Singh's case (supra), CWP No. 1013 of 2017, the case of the petitioner needs to be re-considered.

Notice of motion.

On the asking of the Court, Ms. Deepali Puri Sandhu, Addl. A.G., Punjab, accepts notice on behalf of the respondent-PSPCL and states that the respondent-Corporation will consider the case of the petitioner afresh in view of the event and will pass a fresh order in respect of the claim of the petitioner for the grant of promotional increment after rendering 23 years of service.

Learned counsel for the parties are agreed that the present writ petition can be disposed in terms of order passed in Balvir Singh's case (supra), CWP No. 1013 of 2017.

Keeping in view the prayer made by the parties, the present writ petition is also disposed of in terms of order passed by a Co-ordinate Bench in Balvir Singh's case (supra), CWP No. 1013 of 2017. ( HARSIMRAN SINGH SETHI ) February 11, 2019 JUDGE naresh.k Whether reasoned/speaking?
