The petitioner incarcerated in the FIR captioned above had come up before this Court under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], seeking interim regular bail.

State counsel has opposed the interim bail on the ground of quantity involved and the fact that the marriage is not of the real sister but of cousin of the petitioner.

At this stage, counsel for the petitioner wants to withdraw the present petition with liberty to file an application before the concerned Jail Superintendent for taking the petitioner to attend the marriage in custody. 4.

Disposed of as withdrawn with liberty aforesaid. 5.

It is clarified that Superintendent of Jail shall not refer to this order in case, he/she permits the petitioner to be sent in custody to attend the marriage, which as per the petitioner is of his cousin, rather to take a decision at their own, on merits, in accordance with law.
