Challenge is to order dated 12.07.2024 (Annexure P-2) passed by the Court of learned Additional Sessions Judge, Narnaul in CRA-1002024 titled as "Anil Yadav vs. Krishan Kumar". 2.
Counsel appearing on behalf of the petitioner inter alia submits that the petitioner was granted regular bail by Court concerned vide order dated 04.04.2024 (Annexure P-3) and thereafter the petitioner was regularly appearing before the Appellate Court concerned but was unable to attend the proceedings in the appeal on 12.07.2024 due to some unavoidable circumstances. On account of absence of the petitioner, the Appellate Court passed the impugned order in a hasty manner and the petitioner is ready and willing to join the proceedings at the earliest and he is also ready to deposit 20% of the compensation awarded by the trial Court.

Mr. Arjun Lakhanpal, Addl.A.G., Haryana accepts notice on behalf of the State and submits that the petitioner got absented on 12.07.2024 without any intimation to the Appellate Court concerned which resulted into passing of order Annexure P-2. There is no illegality or perversity in the said order.

It appears that the petitioner is ready and willing to join the proceedings before the Appellate Court at the earliest and has also shown his willingness to deposit 20% of the compensation awarded by the trial Court and further the offence punishable under Section 138 of Negotiable Instruments Act is a bailable offence.

In the light of the above, without expressing any opinion on the merits of the case, the present petition is hereby disposed of with a direction to the petitioner to appear before the Appellate Court concerned and on his doing so, within next 07 days, the petitioner is to be released on regular bail by the said Court to its own satisfaction subject to costs of Rs.10,000/- to be deposited by the petitioner with the District Legal Services Authority, Narnaul. He is also to deposit 20% of the compensation awarded by the trial Court.

Needless to say that the petitioner is to remain careful in future and to appear before the trial Court on each and every date fixed by it.
