**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 203 dated 17.11.2019 under Section 21 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Adampur, District Jalandhar.

Power of attorney on behalf of the petitioner has been filed and the same is taken on record.

Learned counsel for the petitioner submits that the alleged recovery effected from the petitioner falls under the non-commercial quantity and he has been in custody since 17.11.2019. He further submits that the prosecution witnesses are yet to be examined. Learned State counsel has filed the custody certificate by way of affidavit of Narpinder Singh, Deputy Superintendent, Central Jail, Kapurthala and the same is taken on record.

CRM-M No. 6350 of 2020 -2for the last three months. The prosecution witnesses are yet to be examined. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
