RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 482 Cr.P.C. praying for issuance of directions to learned trial Court to conclude the trial in case FIR No.229, dated 13.10.2018, under Sections 307, 353, 186, 332, 333, 427,34, 120B 473, 411 and 201 IPC and Section 25 of Arms Act, registered at Police Station Civil Lines, Batala, District Batala, expeditiously.

It has been contended by counsel for the petitioner that case is pending trial for the last about four years and accused are intentionally delaying the trial.

Notice of motion.

On asking of the Court, Mr.Sandeep Kumar, DAG, Punjab, who is present in Court, accepts notice on behalf of the State and submits, on instructions from ASI Palvinder Singh, that investigation is complete, challan is presented and charges were framed on 19.03.2021. It is further submitted that out of 23 prosecution witnesses, one is already examined and the next date before the trial Court is 03.03.2023. It is submitted that delay, MEENU 2023.02.14 12:48 I attest to the accuracy and integrity of this order/judgment

CRM-M-7613-2023 (O&M) -2if any occurred, is because of ongoing pandemic at that time after filing of the challan. He submits that there are serious allegations against the accused, however, the prosecution would not cause any delay intentionally in the proceedings.

After hearing counsel for the parties and going through the record, the present petition is disposed of with a request to the trial Curt to expedite the trial and conclude the same at the earliest. February 13, 2023 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
