The present petition has been filed under Article 226 of the Constitution of India praying for issuance of a direction to respondents No.2 and 3 to protect the life and liberty of the petitioner at the hands of private respondents No.4 to 6, who are threatening the petitioner to kill him in case he tried to plough and irrigate his land, which is adjacent to the house of private respondents.

Learned counsel appearing for the petitioner inter alia contends that land of the petitioner is situated adjacent to the house of private respondents. They are restraining the petitioner from irrigating his land on the ground that the irrigation water would cause damage to walls of their house. On 30.11.2023 at about 1.30PM when the petitioner was ploughing his land for sowing wheat crop, private respondents came to the spot armed with kassi and dang and forcibly stopped him from ploughing his land. They threatened him with dire consequences if he tried to plough his land. In this regard, he submitted a PANKAJ KUMAR 2024.02.14 18:50 I attest to the accuracy and authenticity of this document

CRWP No.1386 of 2024       representation dated 01.11.2023 (Annexure P-2) to respondent No.2 but no action has been taken thereon so far. It is further contended that the petitioner would be satisfied in case his representation given to respondent No.2 is decided in a time bound manner and necessary steps be taken thereon, in accordance with law.

Notice of motion to the official respondents only. 3.

Mr. Subhash Godara, Addl. A.G., Punjab, who is present in Court, accepts notice for the official respondents and submits that the State is duty bound to protect life and liberty of its citizens and the official respondents will consider the representation of the petitioner as expeditiously as possible, in accordance with law.

Without commenting on merits of the case, I dispose of this petition with direction to respondent No.2 to decide the representation of the petitioner (Annexure P-2) within a period of four weeks from the date of receipt of certified copy of this order and grant him protection, if there is any threat to her life and liberty. It is made clear that this order shall not be taken to protect the petitioner from legal action for violation of law, if any committed by him.
