*** Learned counsel for the petitioner states that he does not want to proceed further with the present petition at this stage and permission be granted to him to withdraw the said petition. However, he has requested that a direction be issued to the trial Court to conclude the trial expeditiously. Learned State counsel has informed that out of 16 PWs cited by the prosecution 14 PWs have since been examined and now the case is fixed for 1.10.2021 for recording statements of remaining PWs.

The petition is dismissed as withdrawn. The trial Court is directed to make earnest efforts to conclude the trial expeditiously by giving short adjournments. The State shall ensure the appearance of the remaining two PWs in the trial Court on the next date of hearing and if for some reason it cannot be done then on the further date, which is to be of short duration. Of course, the accused shall not ask for any adjournment for cross-examination of the PWs. The trial be concluded preferably within a period of three months from the date of receipt of copy of this order in the trial Court.
