Though matters were being taken up through physical hearing mode today, this matter has been taken up through video conferencing on specific request of learned counsel and in terms of circular dated 14.09.2021. It is submitted that petitioner's candidature for the post of PGT Fine Arts is not being considered solely on the ground that she has not cleared her HTET/STET examination. It is submitted that the petitioner is entitled to exemption as she has been teaching the subject of Fine Arts since 01.04.2008 and has submitted her experience certificate for the period of 01.04.2008 to 30.04.2012 duly counter signed by the District Education Officer, Hisar. It is further submitted that petitioner claims parity with candidate Ms. Sunita, bearing roll No. 21100468, who has been issued appointment letter dated 06.05.2021.

CWP-3681-2022 -2Learned counsel for the petitioner further submits that legal notice dated 16.11.2021 was served upon the respondents in this respect but to no avail. At this stage, learned counsel for the petitioner restricts the prayer for a decision on legal notice dated 16.11.2021 (Annexure P10), submitted by the petitioner, in a time bound manner.

Mr. Rohit Arya, DAG, Haryana accepts notice on behalf of the respondents. Advance copy of writ petition stands supplied. Learned counsel for the respondents does not raise serious objection to the restricted prayer addressed.

Keeping in view the limited prayer addressed, facts and circumstances of the case but without expressing any opinion on the merits thereof, this writ petition is disposed of with a direction to the competent authority, to decide legal notice dated 16.11.2021 (Annexure P10), by passing a speaking order, within three months from the date of receipt of certified copy of this order.
