The petitioner has sought issuance of directions upon the respondent No.2 for getting the matter further investigated from some higher official of any independent agency or crime branch, in FIR No.180 dated 16.08.2019, under Section 148, 149, 323, 341, 302, 506 of the IPC, registered at P.S. Nagina, District Nuh.

However, the petitioner has an alternative remedy, in view of the settled law of this land, inasmuch as, the petitioner can approach the Illaqa Magistrate concerned with the grievance, as raised in the instant petition. 3.

Faced with the above situation, the learned counsel seeks leave to withdraw the present writ petition, however, with liberty to raise his grievance before the appropriate forum/court concerned, through instituting an appropriate motion.

The asked for leave is granted and the writ petition is dismissed as withdrawn, however, with liberty (supra).
