Dated Police Station Sections 14.11.2024 Gharinda, District Amritsar Rural 21, 61 of NDPS Act 1.
Seeking interim bail to attend wedding of sister-in-law fixed for 08.02.2025, the petitioner incarcerated in the FIR captioned above had come up before this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS]. 2.
State counsel submits that in such a short span of time, it is not possible for them to verify the factum of marriage and without verification granting interim bail to the petitioner is risky for the reason that he has not only been arrested with commercial quantity of contraband but a revolver was also recovered from the accused persons. 3.
Faced with the situation, counsel for the petitioner wishes to withdraw the present petition with liberty to file an application either before trial Court or before Jail Superintendent for sending the petitioner in police custody to attend marriage. 4.
Given above, the present petition is disposed of with liberty aforesaid. It is clarified that if any such application is filed before the trial Court/Jail Superintendent, they shall take early call on the same. All pending applications, if any, stand disposed of.
