Through the instant petition under Section 438 Cr.P.C., the petitioner seeks anticipatory bail in case FIR No. 81 dated 29.01.2022 registered under Sections 21(b), 27-A of the NDPS Act, at Police Station City Fatehabad, District Fatehabad.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case on the basis of disclosure statement of the co-accused and that though the alleged recovered contraband falls under the commercial quantity, but nothing was recovered from the petitioner.

I have heard the learned counsel for the petitioner and also gone though the paper-book.

As noted by the learned Additional Sessions Judge, Fatehabad, in his order dated 14.02.2022, while declining the anticipatory bail to the petitioner that the petitioner is involved in five other criminal cases including a case under NDPS Act.

  The petitioner has been involved in other cases including NDPS Act. Thus, keeping in view that the petitioner is a habitual offender having repeated and continuous criminal antecedents, he does not deserve concession of the anticipatory bail.

In view of the above, the present petition is dismissed.
