(Oral) Order dated 14.02.2023 passed by this Court says as under: "Prayer in the instant petition filed under Article 226 of the Constitution of India, is for issuance of directions to respondents No.2 to 4, to protect the life and liberty of the petitioner and his family members at the hands of private respondents No.5 to 12.
Dispute regarding the property i.e. Shagun Marriage Palace seems to be entirely of civil nature and civil suits filed by the respective parties are stated to be already pending. Counsel submits that the proceedings under Section 145 Cr.P.C. are also pending its decision before the Court of Sub Divisional Magistrate. Vide referring to the photographs attached with the writ petition as Annexure P-7, counsel submits that on 02.02.2023, some persons forcibly tried to enter the premises, but with the help of police, the same was safeguarded. Petitioner has already submitted a representation dated 03.02.2023 (Annexure P-8) to the Senior Superintendent of Police, Moga, which has been marked to the Deputy Superintendent of Police, but the police officials are pressurizing him to compromise the matter.
Adjourned to 14.03.2023.
Learned counsel for the State to file a detailed report with regard to the contentions raised by the counsel for the petitioner referred above also apprise the Court on the next date of hearing as to whether there is any apprehension to the life and liberty of the petitioner and his family members. "
Today, Mr. Anmol Singh Sandhu, AAG, Punjab, has filed a report dated 13.03.2023 by way of an affidavit of Ajay Raj Singh, PPS, Superintendent of Police, (Inv) Moga, District Moga, on behalf of respondents No. 1, 2 and 4. Same is taken on record. Registry is directed to tag the same at appropriate place.

CRWP-1409-2023 (O&M) -2Relevant paragraph No. 9 of the said report says as under: "9.
That moreover, regarding the allegations leveled by the petitioner in the instant petition that there is apprehension to his life and liberty, the investigation was conducted Superintendent of Police (Inv), Moga and he had directed the DSP, Dharamkot to take appropriate steps for the protection of life and liberty of petitioner and his family. Apart from this necessary directions have been issued to PCR motorcycle and Rural Rapid response system to increase the patrolling towards the work place and residence of petitioner and provide them the mobile numbers of Police Control Room, DSP Dharamkot and petitioner has also been directed that in case he is feeling apprehension to the life and liberty then immediately contact them. Except this necessary directions have been issued to the DSP, Dharamkot and SHO, PS Dharamkot that on receiving the complaint/message from petitioner immediate action should be taken. "
In view of the stand taken by the respondents-State and as noted here-in above, counsel for the petitioner submits that his grievance has been looked into by the State Government, therefore, petition may be disposed of accordingly.
As categoric stand has been taken by the State Government in its reply by taking care of protection of lives and liberty of the petitioner and his family members, no issue is left with the Court to decide. Hence, present petition stands disposed of in view of the stand taken by both the sides and as recorded here-in above.
