Present application under Section 378(4) Cr.P.C. for granting leave to file an appeal. The ground taken in the application that a complaint under Section 138 of the Negotiable Instruments Act, 1881 was filed and the same was pending in the Court of learned Judicial Magistrate Ist Class, Gurgaon on 18.11.2015 and on that day applicant failed to put in appearance for the reasons beyond his control and there was no other reason for his nonappearance, though he was earlier appearing in the Court regularly. In view of the above facts, the present application is allowed. The applicant is granted leave to file an appeal. Appeal be admitted after assigning the number.
