Bharat Singh v. State Of Haryana And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CWP- 11971-2001 (O&M) Date of decision: July 13, 2022 Bharat Singh
...Petitioner
versus State of Haryana and others
...Respondents
CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. Karamvir Hooda, Advocate for Mr. Harkesh Manuja, Advocate, for the petitioner.
Mr. R.D. Sharma, DAG, Haryana.
***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of mandamus directing the respondents to regularize the services of the petitioner with effect from 31.03.1993 in view of the Government Instructions (Annexure P-2).
2.
Petition was admitted for hearing on 14.08.2001. When taken up for adjudication on 05.07.2022, learned counsel for the petitioner had sought time to argue and same was the position on 06.07.2022. When it is taken up today on resumed hearing, on a Court query, learned counsel for the petitioner candidly submits that though he does not have any instructions, his attempts to establish contact with the petitioner have been futile and yet he has prepared the case to argue.
3.
One does not know if by sheer lapse of time, petitioner is interested to pursue the petition and that is why perhaps he has not maintained any contact with the office of the learned counsel. Though it is highly possible, he may not be aware of the listing of the case but the nature of relief sought by him appears to have been rendered infructuous by sheer pendency of the petition for more than 20 years. 4.
Be that as it may, writ petition is disposed of with liberty to the petitioner to file an appropriate application in case, any cause of action still survives.
