IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CWP No.6258 of 2003 (O&M) Date of decision: 10.10.2022 Som Pal

...Petitioner

Vs.

State of Haryana and others

...Respondents

CORAM:

HON'BLE MR. JUSTICE ARUN MONGA

Present:

Ms. Ritu Punj, Advocate for the petitioner.

Mr. R. D. Sharma, DAG, Haryana.

*** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ, order of direction in the nature of mandamus directing the respondents to pay all the arrears of salary on regular basis w.e.f. 20.07.1998 as per the orders passed by the respondents dated 23.10.2002 (Annexure P-11) and the order dated 20.09.2001 (Annexure P-9) passed by this Court in CWP No.14663 of 2001 along with interest @ 18% p.a. from the due date till the actual payment. 2.

Petition was admitted on 08.03.2004.

3.

When taken up for final adjudication, after around 19 years, learned counsel is unable to assist the Court for lack of instructions. Learned counsel for the petitioner states that despite various attempts, her office could not contact the petitioner. In the premise, no useful purpose would be served to issue fresh notice to the petitioner as the same too would be an exercise in futility.

4.

It seems that by sheer effluxion of time and pendency of the writ petition for more than 18 years before this Court, either it has been rendered infructuous or even otherwise the petitioner seems to have lost interest in pursuing the same.

CWP No.6258 of 2003 (O&M) 5.
