RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner in a case arising from FIR No.245 dated 24.09.2018 registered under Sections 15 and 16 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Ellenabad, District Sirsa.
According to the prosecution, on 24.09.2018, six bags containing 12 kgs poppy husk each, totalling 72 kgs, were recovered from the petitioner.
Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 24.09.2018.
In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to furnishing RAVINDER SINGH 2019.02.21 11:56 I attest to the accuracy and authenticity of this document personal bonds and two sureties of ` 2.00 lakh each, to the satisfaction of
-2CRM-M-6527 of 2019 Special Court concerned only till receipt of the FSL report. The petition stands disposed of accordingly.
