CRM-M-7772-2023 This petition has been filed for grant of regular bail in FIR No.403, dated 02.08.2022, registered at Police Station City Fatehabad, District Fatehabad, under Sections 379-A IPC read with Section 34 IPC. 2.
Learned counsel for the petitioner submits that petitioner has been in custody for more than nine months. The trial is not likely to be concluded at an early date as 03 Pws have been examined out of a total of 09 Pws. The complainant stands examined and the matter has been adjourned to today only to await his examination. Thus, the petitioner may be granted regular bail.

Custody certificate dated 24.05.2023 checked by Sh.Dalbir Singh, Deputy Superintendent, Central Jail No.2, Hisar has been filed in Court. The same is taken on record. A perusal thereof shows that the petitioner has undergone actual custody of 09 months and 22 days and there are three other criminal cases pending against him. Learned State counsel concedes that only 03 Pws have been examined out of a total of 09 Pws.

Learned counsel for the petitioner submits that the petitioner is on bail in all the three pending criminal cases. Relevant orders have been shown in Court.

The petitioner has been in custody for 09 months and 22 days and the trial may still take time to conclude. The complainant stands examined and the petitioner is on bail in all the three pending criminal cases, thus, I deem it appropriate to grant regular bail to the petitioner. Accordingly, the petition is allowed. He is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
