(ORAL) The complainant has filed the present application under Section 378 (3) read with Section 482 Cr.P.C. seeking leave to appeal against the judgment dated 01.06.2016 passed by the learned Sessions Judge, Ambala, whereby Kamaljit Singh accused, respondent No.2 herein, was acquitted of the charge under Sections 323, 324, 326, 341 read with Sections 34 and 506 IPC.
On perusal of the judgment passed by the learned lower appellate Court it is made out that though respondent No.2 was previously known to the complainant party, yet he was not named as an accused at the time of registration of FIR. CRM A-1284-MA of 2016 -2In view of the above, no fault can be found with the finding arrived at by the learned Sessions Judge, Ambala, while acquitting respondent No.2-Kamaljit Singh. The application is without any merit and, therefore, dismissed. Leave to appeal is declined.
