ANIL KSHETARPAL, J(Oral) Prayer in the petition is to quash FIR No228, dated 10.09.2017, registered under Section 174-A of the Indian Penal Code, at Police Station Shivaji Nagar, District Gurugram.
It may be noted that the petitioner was an accused in a complaint case under Section 138 of the Negotiable Instrument Act. In those proceedings, he did not appear and therefore, declared proclaimed person. Accordingly, the present FIR was registered. It is not disputed that the petitioner thereafter appeared in the proceedings under Section 138 of the Negotiable Instrument Act and the proceedings have ended into a compromise and consequently complaint was withdrawn. CRM-M-7020-2019(O&M) -2petitioner has already suffered agony of trial, these proceedings in the interest of justice must now come to an end.
Learned counsel for the petitioner has relied upon various judgments passed by Co-ordinate Benches in this regard. Reference to one would be sufficient, titled as Microqual Techno Limited and othres vs. State of Haryana and another, 2015(32) R.C.R.(Criminal), 790. For the reasons recorded in the aforesaid judgment, the FIR No.228, dated 10.09.2017, registered under Section 174-A of the Indian Penal Code, at Police Station Shivaji Nagar, District Gurugram, shall stands quashed.
