Vinay Yadava v. State Of Haryana And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CWP-12146-2001 (O&M) Date of decision: July 13, 2022 Vinay Yadava
...Petitioner
versus State of Haryana and others
...Respondents
CORAM: HON'BLE MR. JUSTICE ARUN MONGA
Present:
Mr. Sandeep Dhull, Advocate, for the petitioner.
Mr. R.D. Sharma, DAG, Haryana.
***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of mandamus directing the official respondents to appoint the petitioner as JBT Teacher from the date when respondent No.3 was appointed. 2.
Petition was filed in the year 2001 and has been lying admitted ever since. When taken up for final adjudication, after around 22 years, learned counsel for petitioner is unable to assist the Court for lack of instructions due to not having proper address and particulars of the petitioner. On a Court query, learned counsel for the petitioner fairly concedes that all his attempts to establish contact with the petitioner have been futile. In the premise, even issuance of fresh notice to petitioner would be an exercise in futility.
3.
It seems that by sheer effluxion of time and pendency of the writ petition for more than 21 years before this Court, it has been rendered infructuous and/or the petitioner seems to have lost interest in pursuing the same. 4.
Be that as it may, writ petition is disposed of with liberty to the petitioner to file an appropriate application in case, any cause of action still survives.
