The challenge in the present revision petition is to order dated 19.12.2019 whereby two applications have been disposed off by a common order. One application having been filed by the petitioner under Order VI Rule 17 of the Code of Civil Procedure, 1908 and one application having been filed under Order I Rule 10 CPC. Both the applications were jointly dealt with and dismissed vide a common order dated 19.12.2019. 2.

Learned counsel for the petitioner would contend that when there were two separate applications the same ought to have been decided vide separate orders. In support of his contention he has relied upon an order passed by this Court in the case of Nirmal Singh & Ors. vs. Tarsem Singh & Ors. [2015 (2) RCR (Civil) 679].

Learned counsel for the respondent states that he has no objection if the present revision petition is allowed and the matter is remanded for a decision afresh on both the applications. 4.

In view of the above, the present revision petition is allowed, the impugned order is set aside and the matter is remanded for a decision afresh on both the applications.

Disposed off in the above terms. Pending applications, if any, also stand disposed off.
