Mr. Vivek Singla, Advocate for respondent No.3. **** KARAMJIT SINGH, J.(ORAL) The present petition has been filed by the petitioner/defendant, being aggrieved of the order dated 03.02.2021 passed by the Court of Additional District Judge, Faridabad whereby while disposing an application filed by the petitioner seeking stay of the impugned judgment and decree, the same was stayed subject to deposit of 50% of the decreetal amount in the form of bank draft or the FDR within next 15 days by the petitioner. Both the counsel apprised the Court that the appeal is still pending in the Court of Additional District Judge, Faridabad and the present petition could be disposed of with necessary direction to the First Appellate Court to decide the appeal in a time bound manner.
In light of the above, the present petition is hereby disposed of with a direction to the Court of Additional District Judge, Faridabad to decide the Civil Appeal No.54 of 2020 titled as "Tier Infrastructure Pvt. Ltd. Vs. Nepal Singh and Others" in accordance with law POONAM SHARMA 2023.07.20 10:26 I attest to the accuracy and integrity of this document
CR No.402 of 2021 2023:PHHC:089859 preferably within next three months after receipt of copy of this order and till then the operation of the impugned order dated 03.02.2021 is stayed. However, in case the appeal is not decided within the stipulated period due to delay on part of the petitioner, then the impugned order will automatically revive.
