(ORAL) By way of the instant petition, the petitioner seeks the relief of issuance of a writ in the nature of mandamus directing respondents No.1 and 2 to extend the age of his retirement from 58 years to 60 years in view of the instructions dated 19.11.2014 (Annexure P-5) and also to take a decision on the letters dated 19.11.2020, 01.01.2021 and 21.01.2021 (Annexures P-6, P-8 and P-9, respectively). He has made a further prayer for staying the operation of the letters dated 15.12.2020 (Annexure P-7) and 10.02.2021 (Annexure P-10) during the pendency of this petition, while averring that despite the fact that his permanent disability has already been assessed by the Competent Authority to be 50%, the respondent-Department is asking him to get his disability re-assessed for the purpose of considering his aforesaid claim. Mr. Nikhil Chopra, Addl. A.G., Punjab, has joined the proceedings on behalf of all the respondents in pursuance of the copies of NEETU RANI 2021.02.24 13:39 I attest to the accuracy and integrity of this document PHHC

Learned counsel for the petitioner submits the petitioner would be satisfied in case a direction is issued to respondent No.2 to decide his representation dated 19.02.2021 (Annexure P-11), while giving him an opportunity of being personally heard, within a specific time-frame as the petitioner is due to superannuate/retire on 28.02.2021. Learned State counsel has no objection for the same. Keeping in view the above-discussed limited prayer of learned counsel for the petitioner and without commenting upon the merits of the matter in hand, the instant writ petition is hereby disposed of with a direction to respondent No.2, i.e. Director, Research and Medical Education, Punjab, to consider and decide the said representation of the petitioner (Annexure P-11), in accordance with the relevant rules/instructions/law/policy, on or before 26.02.

2021, after affording him an opportunity of being personally heard in this regard on 25.02.2021. The petitioner, through his counsel, is directed to appear before respondent No.2 on 25.02.2021 at 11:00 AM. This petition stands disposed of accordingly.
